Proposal to set the maximum rent increase in 2021 at 1% + inflation (total 2,4%)

At the end of 2020, Minister Ollongren signed a deal with the PvdA and GroenLinks to get the housing budget through the Senate. Among others, 450 million euro will become available for quality of life in vulnerable areas.
But for the first time, from 1 July 2021, there will also be a maximum annual rent increase for both the private sector and the social sector of 2.4%. Previously, there was only a maximum rent increase in the social sector. In the free sector there was no maximum rent increase, unless this was stipulated in the lease.

The new maximum only applies to sitting tenants! If a new tenant starts to rent the house, landlords may determine the rent again.

It's not definite yet, the law has yet to be passed
For this, a new law must be passed by the House of Representatives and the Senate. It could happen that you have made a different agreement with your tenant in the lease. With this, contracts would be overruled by the government. The question is whether that is legally possible

The social sector
Tenants have always been protected in the social sector. The rental price is determined here on the basis of the points system. There was also always a maximum rent increase. Next year, 2.4% will also be the maximum in the social sector, which is considerably lower than in previous years. In 2020, for example, rents in the social sector were allowed to increase by a maximum of 3.9%.

Skewed income-to-rent ratio
In order to combat skewed living, an income-related rent increase also applies in the social sector. For tenants with a gross annual income higher than € 44,655.00, instead of the maximum of 2.4%, a maximum rent increase of 5.4% applies. The higher income-related rent increase also applies to tenants with a middle income who already live in a relatively expensive social housing. This measure should make rents in the social sector less attractive to people who have an income that is too high.

Update March 2021: rental prices in the social sector may in 2021 NOT be increased at all.
