Definitive energy label has to be mentioned in advertisements as of January 1, 2022

Since January 1, 2015, it is a legal requirement to provide a definitive energy label to the tenant / buyer when renting or selling a home. You can get a fine of € 435.00 if you sell or rent your home without a definitive energy label. This definitive label must be present at the time of transfer. Are you a company? Then the fine is even € 870.00!

Active enforcement as of 1 January 2022
Although the obligation exists for years, until now it was not actively enforced. As of January 1, 2022, the government will actively enforce this by introducing an advertising obligation. From this date it is mandatory to mention the final energy label in the advertisement on f.i. websites as Funda and Pararius, but also on social media channels. If the definitive energy label is missing from an ad, fines can be issued to sellers / landlords.

Searchers can filter on final energy label
We can still place the advertisement, but you run the risk of a high fine if no definitive energy label is present. Moreover, searchers can filter on 'final energy label', which means that they will not even see the properties without a definitive label or with a provisional energy label. As a result, your property will potentially receive less attention without a definitive label.

Apply for the energy label on time
Until 2020, you could easily apply for the energy label online for about € 10.00. Since last year, applying for an energy label has become much more expensive because a certified advisor now has to visit the property. As a result, the issuance of the label also takes longer. Currently it takes about 1-2 weeks before you receive the definitive energy label. The energy label will therefore have to be applied for, prior to the rental process.
